The Ministry of Finance announcing the postpoment of the obligatory National e-Invocing System (KSeF) surprised many taxpayers. Minister Domański’s decision has raised many questions, including the most problematic one: what’s next with KSeF?

As we wrote here: https://www.nexiaadvicero.eu/en/the-deadline-for-the-use-of-e-invoices-in-poland-has-been-postponed/, the new KSeF implementation date will depend on the results of the system audit carried out, so as of now it remains unknown. However, on February 2^nd a press briefing was held that illuminated many issues:

1. The new implementation date will be announced to the taxpayers in late April and early May.

2. The earliest implementation date is January 2025.

3. No changes are foreseen in terms of:

• Schema and technical solutions,
• The date of issuing an e-Invoice,
• Extending the deadline for invoices issued outside KSeF in case of system failure.

4. The Ministry of Finance plans to hold consultations with taxpayers regarding not only the functioning of the system, but also the possible postponement of statutory deadlines. The consultations mentioned earlier would take place in so-called working groups:

• Small and micro businesses and flat-rate farmers,
• Medium and large businesses and local government units,
• Accountants and IT,
• Group dedicated for explanations, training, and information.

5. The legislative process regulating KSeF will end in June 2024.
