The employer is obliged to grant an additional day off for a Saturday holiday. In the near future, this obligation applies to January 6, 2024 (Saturday).

The day off should be granted to the employee within a given settlement period, i.e. if the Employer’s settlement period is a monthly period, then the day off for January 6 should be granted in January 2024. If a given employer has a settlement period longer than 1 month, please remember that the day off must be granted until the end of this settlement period. Giving a day off may take place both before and after a given holiday.

If the employer does not grant the employee a day off for a public holiday falling on Saturday, after the end of the settlement period, he will be obliged to pay 100% of overtime remuneration.

The employer may decide to establish one day off as part of the general public holiday for all employees or allow employees to freely choose a day off as part of the holiday.

If the employee is on sick leave on a day designated as a day off for a holiday falling on a Saturday, there is no obligation to grant him a day off on another date.

Please provide information on the date of collection of the holiday by employees along with data for the payroll for January.
